TERMS OF USE, CONDITIONS, & WAIVER OF LIABILITY

ACCEPTANCE OF TERMS, CONDITIONS AND WAIVER OF LIABILITY BY ALL ARTISTIC PROGRAMMING PARTICIPANTS AND VISITORS TO ANY PREMISES USED BY SAAM:

Glossary of Terms:

Studio/Club refers to the South Asian Arts Movement Society (SAAM) and any of its affiliates (including but not limited to Ashley Anjlien Kumar, AKtion Fitness Ltd. and/or other partners and representatives offering programming through SAAM.

ASSUMPTION OF RISK OF INJURY AND LIABILITY WAIVER: I assume all risks of injury and waive all rights to pursue money damages or any other relief of any kind as a result of anything occurring at or near the Studio/Club Location or any other venue used by or it’s employees, officers, directors or other representatives (including but not limited to dance and/or fitness instructors and/or personal trainers). In the event I am injured while on a property used to conduct classes, I will hold harmless the Studio/Club and all of its owners, shareholders, employees, agents, representatives, successors and assigns from all claims of any sort for damages or relief, including but not limited to claims for contribution. I acknowledge there is possible danger connected with any physical activity (including the dangers of physical injury and death) and knowingly and voluntarily waive my right to make a legal or equitable claim of any sort against the Studio/Club and all of its owners, shareholders, employees, agents, representatives, successors and assigns from all claims of any sort for damages or for other relief, including but not limited to claims for contribution. This assumption of risk and wavier of liability applies to my family members, successors, heirs, and assigns.

PHYSICAL CONDITION AND NO MEDICAL ADVISE: I represent that I am in good physical condition and have no medical reason or impairment that might prevent me from my participation or intended use of the Studio/Club and the services offered. I acknowledge that the Studio/Club and all of its owners, shareholders, employees, agents, representatives, successors and assigns will not and cannot provide me medical advice relating to my physical condition and ability to use the facilities/participate in fitness, dance or yoga programs/classes. If I have any health or medical concerns now or after joining a fitness, dance or yoga class, I will discuss them with my doctor before attending & participating in any classes or using the Studio/Club’s services.

DEATH AND DISABILITY: If I die or become totally or permanently disabled, upon reasonable written notice to the Studio/Club of the death or disability, either I or my estate may cancel this agreement and receive a pro-rata refund for my unused sessions/classes.

CANCELLATION AND REFUND: To cancel this agreement, the client must notify the Studio/Club Management in writing. FOR FITNESS (including Dance-Fitness) CLIENTS, no refund will be given outside the 5th day after this agreement is signed unless for verified medical reasons; if medical reason is verified, and 10% administrative charge shall be applied prior to the process of any pro-rata refund. For ALL clients including DANCE CLIENTS, a refund of unused classes, MINUS 10% administrative charges, can be provided upon withdrawal from any dance term.

I, the undersigned, waive and release the Studio/Club and its employees, officers, directors or other representative from any and all claims in any way connected with my participation in this program. This agreement is binding on my heirs and executors. I understand that ALL aspects of this wavier apply to any children that I bring with me to the Studio/Club, or any participating children for whom I am the legal guardian of and I agree that all the terms shall be binding upon said children. I acknowledge that I am the legal guardian of the children listed on the required class registration form, as applicable. By signing this document, I acknowledge that I have read or heard this document in its entirety and that I fully understand it. I have asked any questions that may have occurred to me and have been answered to my satisfaction. A legal guardian/parent must sign for any participants under the age of 18 years.

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the www.saamovement.com website (the "Service") managed by the South Asian Arts Movement Society (SAAM) ( also refers to"us", "we", or "our" for the purposes of the Terms.). SAAM has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that SAAM shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any thirdparty web sites or services that you visit.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to
be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
